Overview of CASL
CASL is one of the strictest anti-spam laws in the world, and it applies to all forms of electronic communication, including emails, social media messages, and Canada Phone Number List SMS messages. The law came into effect on July 1, 2014 and is designed to protect consumers from unsolicited commercial electronic messages.
Key elements of CASL affecting SMS marketing:
Consent: Under CASL, businesses must obtain express consent from individuals before sending them commercial electronic messages. This means that marketers must get clear, written consent (e.g., through an opt-in process) before sending an SMS message.
Express Consent: This is the preferred form of consent. It is obtained when an individual clearly agrees to receive messages, typically through a checkbox or similar action, where the individual knowingly opts in. For SMS marketing, express consent could be obtained when a user subscribes to a service via a short code or submits their phone number for marketing purposes.
